Pingvite Terms of Service

Welcome to Pingvite! These Terms of Service ("Terms") govern your use of the Pingvite application ("App") operated by Hoessly Labs, a sole proprietorship registered in Winterthur, Switzerland ("we", "us", "our").

By using Pingvite, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility and Age Requirements

You must be at least 14 years old to use Pingvite.
If you are under 18, you confirm that your parent or legal guardian has reviewed and consents to these Terms and your use of the App.
By creating an account, you represent that you meet these requirements.

2. What Pingvite Does

Pingvite is a social app that helps you coordinate hangouts with friends. The App:

Shows you cards of people to potentially hang out with
Facilitates matching when two users (or more) want to meet
Helps coordinate time and place for meetups
Sends SMS notifications about matches and plans

3. What Pingvite Does NOT Do

IMPORTANT: Pingvite is a coordination tool only. We do NOT:

Organize, supervise, or attend any in-person meetings
Verify the identity, background, or intentions of users
Guarantee the safety of any meetup
Take responsibility for what happens when users meet in person

4. User Conduct

You agree to:

Provide accurate information in your profile
Use Pingvite only for lawful purposes
Treat other users with respect
Not harass, threaten, or harm other users
Not impersonate others or create fake accounts
Not use the App for commercial purposes without permission
Not attempt to hack, disrupt, or reverse-engineer the App

We may suspend or terminate accounts that violate these Terms.

5. Safety and Meetups — YOUR RESPONSIBILITY

You are solely responsible for your safety when meeting other users.

We strongly recommend:

Meet in public places (cafes, parks, schools)
Tell someone where you're going and who you're meeting
Trust your instincts — if something feels wrong, leave
Don't share sensitive information (home address, financial info) with people you just met
For minors: Inform a parent or guardian about your plans

Pingvite cannot and does not guarantee your safety. Real-world interactions carry inherent risks that are beyond our control.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY SWISS LAW:

Pingvite is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied.
We do not warrant that the App will be uninterrupted, error-free, or secure.
We are not liable for any interactions, disputes, or incidents between users.

HOESSLY LABS SHALL NOT BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages
Any loss of profits, data, or goodwill
Any damages arising from your interactions with other users
Any damages exceeding the amount you paid us in the past 12 months (if any)

This limitation applies regardless of the legal theory (contract, tort, negligence, or otherwise).

7. Indemnification

You agree to indemnify, defend, and hold harmless Hoessly Labs, its owner, employees, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from:

Your use of Pingvite
Your violation of these Terms
Your interactions with other users
Any content you submit to the App
Your violation of any third-party rights

8. User Content

You retain ownership of content you submit (photos, messages). By submitting content, you grant us a license to use, display, and distribute it within the App. You are responsible for ensuring you have the right to share any content you upload.

9. SMS Communications

By creating an account, you consent to receive SMS messages from Pingvite, including:

Verification codes
Match notifications
Hangout reminders

Standard messaging rates may apply. You can opt out of non-essential messages by contacting us.

10. Account Termination

You may delete your account at any time by contacting us.
We may suspend or terminate your account for violations of these Terms.
Upon termination, your right to use the App ends immediately.

11. Changes to Terms

We may update these Terms from time to time. The "Last updated" date reflects the current version. Continued use after changes constitutes acceptance. For material changes, we will notify you via the App or email.

12. Governing Law and Disputes

These Terms are governed by the laws of Switzerland. Any disputes shall be resolved in the courts of Winterthur, Canton of Zurich, Switzerland.

13. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hoessly Labs regarding Pingvite.
